The crypto industry’s long-sought US regulatory bill is likely dead in its current form after Democrats swept both chambers of Congress, industry experts say, despite the roughly $170 million crypto political groups poured into the elections.
“For crypto, the Democratic sweep may well be the final nail in the Clarity Act’s coffin,” Mati Greenspan, founder of Quantum Economics, told CoinDesk, noting the bill could not clear a procedural vote in September even under Republican control. Stefan Muehlbauer, head of US government affairs at security firm CertiK, called it “dead in the water in its current form,” and TD Cowen analysts said a Democratic Congress kills the bill for two years.
The Clarity Act was meant to settle which agencies police crypto markets and how tokens and the companies handling them get regulated. Incoming Democratic majorities take over House and Senate committees in January, with power to investigate crypto companies and President Trump’s own crypto ventures, a prospect that has already rattled Trump-linked tokens.
Not everyone sees a funeral. Some industry leaders argue the sweep opens a path to a tougher bipartisan bill with stronger consumer protections and conflict-of-interest rules, pointing out that more than 70 House Democrats previously backed the legislation. For the millions of Americans holding crypto, the practical effect is that clear national rules remain out of reach, and the state-by-state patchwork continues.
