Senate Majority Leader John Thune and other senior Republicans asked a U.S. appeals court Wednesday to overturn a ruling concerning the Environmental Protection Agency’s handling of California emissions waivers, Reuters reported.
The EPA had granted California waivers under the Clean Air Act allowing the state to set its own emissions standards for cars and trucks, as well as lawn-and-garden equipment.
In June, the agency sent those waivers to Congress for possible repeal. A U.S. district judge subsequently found that the EPA’s action was likely unlawful, according to Reuters.
The Republican request seeks to overturn that ruling. It is an appeal request, not a court victory, repeal of the waivers or change in the standards.
For vehicle and equipment businesses covered by California’s standards, the dispute concerns the legal process for challenging the waivers. Wednesday’s request does not itself change their rules.
